Orders and Payment Terms

Order Confirmation
When you place your order, we will send you an order confirmation with your order number.

Order Tracking
Once your order has shipped, we will send you a shipping confirmation email containing your tracking number(s). Some orders will ship in multiple boxes and each box will have its own unique tracking number.

Pay Methods Accepted
We do accept Visa, Mastercard, American Express and Discover.
Your credit card will only be charged once your order has shipped. Most orders ship within 2 business days of receiving your order, if the items are immediately available.
Orders will be subject to a “pending charge” at the time of order, which confirms that the payment account exists. No money will be withdrawn, and the pending charge should be removed from your account once verified.

Sales Tax

Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total, and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such.

Shipping and Handling Charges

Ground Shipping
Due to ongoing freight delays across the country, please allow up to 7-10 days for your order to ship. Excludes federal holidays. No shipping to P.O. Boxes. The state or province may require tax to be applied to shipping and handling charges.

Delivery to Extended Areas
There will be an additional $50 shipping fee for all orders eligible for delivery to extended areas, which include Northwest Territories, Yukon, Newfoundland and Labrador.

Delivery of Large Items
We use a specialty delivery service to deliver large items, including cargo boxes. Sorry, we currently do not deliver the identified large items to Northwest Territories, Yukon, Newfoundland and Labrador.

These terms and conditions (these “Terms of Sale”) apply to the purchase and sale of products and services through the website, www.sportrack.com, and all its subdomains as well as mobile applications, owned, operated or maintained by SportRack (collectively the “Website”). These Terms of Sale are subject to change by SportRack, Inc. (referred to as “us”, “we”, or “our” as the context may require) without prior written notice at any time, in our sole discretion. Any changes to the Terms of Sale will be in effect as of the “Last Updated Date” referenced on this page. You should review these Terms of Sale prior to purchasing any product or services that are available through the Website. Your continued use of the Website after the “Last Updated Date” will constitute your acceptance of and agreement to such changes.

Order Acceptance and Cancellation

All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.

Prices and Payment Terms
All prices on the Website are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total, and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We may offer from time to time promotions on the Website that may affect pricing and that are governed by terms and conditions separate from these Terms of Sale. If there is a conflict between the terms for a promotion and these Terms of Sale, the promotion terms will govern.

Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of an order. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Website at the time of your order.

Shipping
We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process. Shipping and handling charges are reimbursement for the costs we incur in the processing, handling, packing, shipping, and delivery of your order.

Returns and Refunds
SportRack takes quality seriously when it comes to both our products and our service to our customers. If you are not completely satisfied with your purchase, you may return your product in its original packaging within 30 days of the purchase date for a refund. For any damaged or defective products, please consult our guarantee.

For items purchased on www.sportrack.com, please read the following information:

• Returns and refunds are only accepted from items purchased via www.sportrack.com.
• Items must be returned within 30 days of purchase, in new condition, with the packing slip, in original packaging, and with all included accessories.
• Free shipping: SportRack will provide a pre-paid UPS label for all returns.
• Original shipping charges are not refundable.
• Your credit card will be credited for the invoice price. Your credit will appear after SportRack has received and processed your return through our return procedure.
• Please allow 3-5 business days for our warehouse to process your returned package(s) upon arrival and an additional 5-10 business day for the credit to appear on your card.
• Cargo boxes, keys, locks and spare parts are not eligible for our return guarantee. If you have any additional questions, please contact us directly.
• Return an item by following the instructions and filling out the Return Request Form.

Warranties
All purchases through our site are governed by our Warranty, which are hereby incorporated into these Terms of Sale.

Fit Guide Disclaimer
The SportRack “Fit Guide” on the Website and any outcome thereof, is supplied solely as a service, for information purposes only, and does not contain any advice or recommendation that may be relied upon as the basis for any decision or action. All data and information supplied through the “Fit Guide” derive from testing of SportRack products on specific third party products. Technical components and performance quality etc. of such third party products and parts thereof may at any time following the SportRack testing be altered (without the involvement or knowledge of SportRack). Consequently, neither SportRack nor any company associated with SportRack shall (unless otherwise explicitly provided for under mandatory legislation) be liable for property damage or personal injury caused by the use of a SportRack product which deviates from any instruction guide or user manual that (i) accompanies the SportRack product at purchase thereof or (ii) applies to the product(s) on which the SportRack product shall be fitted on or used together with. Prior to the use of each SportRack product, SportRack encourages you to thoroughly read each such instruction guide or user manual.

Goods Not for Resale or Export
You represent and warrant that you are buying products or services from the Website for your own personal or household use only, and not for resale or export. You further represent and warrant that all purchases are intended for final delivery to locations within the US.

Applicable Law; Jurisdiction
These Terms of Sale and any disputes arising under or related to these Terms of Sale will be governed by the laws in effect in the State of Connecticut, without reference to its conflicts of law principles. Any legal actions, suits or proceedings arising out of these Terms of Sale will be brought exclusively in the Connecticut state or federal courts, as applicable, located in Fairfield County, and SportRack and you hereby accept and submit to the personal jurisdiction of these Connecticut courts with respect to any legal actions, suits or proceedings arising out of these Terms of Sale. SportRack and you also waive to the fullest extent permitted by law any right to a trial by jury in any action, suit or proceeding brought to enforce, defend or interpret any right or remedies under, or arising in connection with or relating to, these Terms of Sale.
